Terms & Conditions
These Terms and Conditions (“T&C”) govern participation in the Campaign India Digital Crest Awards (“CIDCA”) organized by Haymarket Media (India) Private Limited (“HMIL”). By submitting an entry, all participants (“Entrants”) are deemed to have read, understood, and accepted these T&C.
- Eligibility – Who Should Enter?
- The Awards are open to participation from all stakeholders engaged in the creation, execution, or delivery of digital campaigns, including but not limited to:
- Brands and clients,
- Digital and creative agencies,
- Advertising and media agencies,
- Publishers,
- Production houses,
- Design studios, and
- Marketing service providers.
- In the case of campaigns developed through collaboration among multiple parties, coordinated entries are encouraged.
- Employees of HMIL, its group companies, affiliates, associates, and their immediate family members are not eligible to participate in the Awards.
- Entry Conditions
- Entrants shall provide complete, accurate, and truthful information while completing the registration form. Submission of incorrect, misleading, or incomplete information may result in disqualification at the sole discretion of HMIL.
- HMIL reserves the right to disqualify any entry at any stage of the Awards without assigning any reason.
- All entries must comply with the eligibility criteria, entry guidelines, timelines, and submission formats prescribed by HMIL. Entries not adhering to these requirements shall be disqualified.
- Judging and Awards
- All eligible entries will be reviewed and evaluated by an independent panel of judges appointed by HMIL.
- The judging criteria shall be determined by HMIL and/or the panel of judges and may vary depending on the category.
- The decision of the jury, validated by HMIL, shall be final, binding, and not subject to challenge or correspondence.
- HMIL reserves the right not to confer an award in any category if, in the opinion of the jury, no entry meets the requisite standard.
- Awards, trophies, citations, or any other recognitions conferred are non-transferable, non-negotiable, and cannot be exchanged for cash or kind.
- HMIL reserves the right to make changes to the Awards rules at any time without prior notification, including the right to substitute or replace any Award recognition, benefit, or associated element with another of equivalent value.
- Winners will be formally announced at the Awards Night. Shortlisted Entrants shall also be notified in advance via their registered email and/or mobile number for RSVP purposes and confirmation of attendees. HMIL’s responsibility is limited solely to such communication.
- Taxes and Compliance
- All statutory taxes, duties, levies, including income tax, gift tax, and/or TDS (Tax Deducted at Source), as applicable under Indian law, shall be borne exclusively by the recipients of the Awards, wherever applicable.
- The delivery of any Award-related prize, gift, or benefit shall be strictly subject to the recipient’s compliance with all statutory requirements, formalities, and production of documents as may be prescribed by HMIL. Failure to comply shall entitle HMIL to forfeit the Award-related benefit and confer it on another eligible Entrant.
- Verification and Documentation
- Entrants and/or Award recipients may be required to submit valid identity and address proof (such as PAN Card, Aadhaar Card, Passport, or Driving License).
- Failure to submit the requisite documentation within the stipulated time may lead to disqualification or forfeiture of the Award.
- Intellectual Property and Rights of Use
- By submitting an entry, the Entrant represents and warrants that it holds all necessary rights, permissions, licenses, and authorisations in the submitted work, including third-party materials incorporated therein, and that such submission does not infringe any intellectual property or other proprietary rights of any third party.
- Entrants grant HMIL and its affiliates a worldwide, non-exclusive, royalty-free, perpetual, transferable license to use, reproduce, adapt, modify, display, publish, communicate, and distribute the submitted entry (including campaign details, creatives, case studies, and credits) for purposes connected with the Awards, including judging, promotion, publicity, editorial coverage, archival reference, and display across print, digital, social, and audio-visual platforms.
- HMIL and the judging panel accept entries in good faith and shall not be held responsible for any infringement of intellectual property rights, moral rights, or third-party claims arising out of submitted works. Entrants shall indemnify and hold HMIL harmless against such claims.
- Publicity and Use of Personal Information
- By entering the Awards, Entrants, shortlisted participants, and Award recipients grant HMIL and its affiliates the unrestricted right to use their name, company name, logo, photograph, likeness, voice, and comments for promotional, editorial, advertising, or publicity purposes, worldwide and in any media, without additional compensation, approval, or notice.
- Entrants and Award recipients expressly consent to HMIL and its affiliates capturing, recording, and publishing photographs, videos, audiovisuals, and personal preferences (such as likes and dislikes) in connection with the Awards. Such consent shall be irrevocable, perpetual, and royalty-free.
- Entrants acknowledge and expressly consent to the collection, processing, storage, and use of their personal information (including but not limited to identity proofs, contact details, and RSVPs) by HMIL and its affiliates for purposes of Awards administration, winner communication, compliance with statutory requirements, and related promotional activities, in accordance with applicable laws.
- Limitation of Liability
- Except for obligations expressly assumed under these T&C, HMIL shall not be liable for any direct, indirect, incidental, or consequential loss, damage, or claims arising out of participation in the Awards.
- Apart from entitlement to the Award, recipients or their legal heirs shall have no further rights, remedies, or claims of any nature whatsoever against HMIL.
- HMIL shall not be liable for any defect, deficiency, delay, or quality issues relating to any trophy, citation, certificate, gift, prize, or associated benefit provided as part of the Awards.
- The Entrant agrees and undertakes not to hold HMIL and/or its affiliates, directors, officers, employees, agents, or representatives responsible or liable for any actions, claims, demands, losses, damages, costs, charges, or expenses suffered, sustained, or incurred, whether directly or indirectly, in connection with participation in the Awards.
- Force Majeure
- The Awards are subject to force majeure conditions.
- HMIL reserves the right to amend or withdraw the Awards in the event of any unforeseen circumstances outside its reasonable control.
- HMIL shall not be liable for any loss or damage due to any delay, modification, suspension, or cancellation in compliance with any law, ruling, order, regulation, requirement or instruction of any Central/State Government, or for any other unavoidable reason beyond their control.
- Entrants shall be informed of such discontinuance/cancellation as soon as possible.
- Governing Law and Jurisdiction
- These T&C shall be governed by and construed in accordance with the laws of India.
- All disputes arising out of or in connection with the Awards shall be subject to the exclusive jurisdiction of the courts at Mumbai.
In addition to these Awards Terms and Conditions, entrants are bound by the general Terms of Use of HMIL’s website, accessible at www.haymarketmedia.in/terms.aspx
